Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, products, and services offered by Shoot Indoors KOP, LLC, a Pennsylvania limited liability company ("Shoot Indoors," "we," "us," or "our"), including but not limited to our indoor shooting range, memberships, training programs, private instruction, firearm rentals, and all related services (collectively, the "Services"). By accessing our website, creating an account, registering for membership, making purchases, or using any of our Services, you agree to these Terms and our Privacy Policy. If you do not agree to these Terms, do not access or use our Services.

1. Eligibility and Age Requirement

You must be at least 18 years of age to access or use our Services, including our shooting range and all related facilities. Minors under 18 may use our Services only under the direct supervision of a parent or legal guardian who is at least 18 years old and present at all times. If you are accessing or using our Services on behalf of another person or entity, you represent that you are authorized to accept these Terms on that person or entity's behalf. The person or entity on whose behalf you are acting shall be responsible for compliance with these Terms.

2. Account Creation and Security

2.1 Account Registration

To access certain features of our Services, including membership registration and private instruction booking, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to promptly update any changes. You are responsible for maintaining the confidentiality of your account credentials and password. You agree to notify us immediately if you discover or suspect unauthorized access to your account.

2.2 Electronic Communications

By using our Services, you consent to receive electronic communications from us, including emails regarding membership status, payment confirmations, event notifications, and important updates. These communications are part of your relationship with us and satisfy any legal communication requirements.

3. Membership Cancellation and Refunds

3.1 Membership Lock-In Period

Standard and Hero memberships require a minimum commitment of six (6) months. You may not cancel during this initial lock-in period. After the six-month period expires, you may cancel your membership at any time.

3.2 Cancellation Procedure

To cancel your membership after the lock-in period, you must provide written notice of intent to cancel at least thirty (30) days in advance. Cancellation requests must be submitted in writing to ensure proper processing. All cancellation requests take effect at the end of the then-current billing period in which the request is received. You will be charged in full for all fees accrued through the cancellation date. Inactivity does not constitute automatic cancellation.

3.3 Non-Refundable Payments

All membership registration fees are non-refundable. Once purchased, membership periods cannot be transferred, paused, or refunded. Private instruction, Royal Package experiences, day passes, and event fees are all non-refundable once payment has been processed.

3.4 Annual Membership Renewal

Annual memberships automatically renew unless you provide written notice of cancellation prior to the renewal date. Renewal charges will appear on your payment method on file. Annual memberships are non-refundable and non-transferable.

4. Waiver and Liability Release

All users of our Services, including shooting range access, training, and events, must complete and electronically sign a comprehensive Liability Waiver and Release of Claims before arrival at our facility. Firearms use and shooting sports carry inherent risks of serious injury or death. By signing the waiver, you acknowledge these risks and voluntarily assume all responsibility for your participation. Your electronic signature constitutes a binding legal agreement.

5. Payment and Billing

5.1 Payment Authorization

By providing a credit card or other payment method, you authorize Shoot Indoors and our payment processor, Authorize.net, to charge your payment method for all fees, dues, purchases, and applicable taxes. You represent and warrant that you are authorized to use the designated payment method and that all information provided is accurate and current.

5.2 Recurring Billing

Membership payments are recurring charges that will be automatically billed at the interval specified (biweekly or annually). Your membership is continuous until you cancel according to Section 4 of these Terms. You authorize us to charge your payment method on the same date each billing cycle. The amount billed may vary due to tax changes, currency fluctuations, or promotional adjustments.

5.3 Failed Payments

If a payment fails, your account may be suspended until the issue is resolved. You are responsible for updating your payment information if your card expires or becomes invalid. Repeated failed payments may result in account termination and forfeiture of membership benefits.

7. Intellectual Property

All content on our website, including text, graphics, images, logos, videos, and software, is owned or licensed by Shoot Indoors and protected by copyright and intellectual property laws. You are granted a limited, non-exclusive license to view and use this content for personal, non-commercial purposes only. You may not reproduce, distribute, modify, or publicly display any content without our prior written permission.

8. Disclaimers of Warranties

OUR SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, OR NON-INFRINGEMENT. WHILE WE TAKE REASONABLE SAFETY PRECAUTIONS, WE CANNOT AND DO NOT GUARANTEE THE ABSENCE OF ACCIDENTS, INJURIES, OR DEATH. FIREARMS USE INVOLVES INHERENT RISKS THAT CANNOT BE ELIMINATED. YOU USE OUR SERVICES AT YOUR OWN RISK AND ASSUME ALL RESPONSIBILITY FOR INJURIES OR DAMAGES RESULTING FROM YOUR USE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY PENNSYLVANIA LAW, SHOOT INDOORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, INCLUDING LOST PROFITS, LOSS OF DATA, OR PERSONAL INJURY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR OUR SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM. THESE LIMITATIONS DO NOT APPLY TO CLAIMS ARISING FROM OUR GROSS NEGLIGENCE, WILLFUL MISCONDUCT, OR VIOLATIONS OF LAW.

10. Indemnification

You agree to indemnify, defend, and hold harmless Shoot Indoors, its owners, employees, agents, and representatives from any claims, damages, losses, liabilities, costs, and expenses (including attorney's fees) arising from: (a) your use of our Services; (b) your violation of these Terms; (c) your violation of any applicable law or regulation; (d) your violation of any third-party right; or (e) your conduct at our facility. You agree to notify us promptly of any third-party claims and to cooperate fully in defending such claims.

11. Opt-Out

You may opt out of arbitration by providing written notice to Shoot Indoors within thirty (30) days of first accepting these Terms. Notice must include your full name and clearly state your intent to opt out.

12. Governing Law

These Terms and your use of our Services shall be governed by and construed in accordance with the laws of the Commonwealth of Pennsylvania, without regard to conflict of law principles. Any dispute not subject to arbitration will be resolved in the courts of Pennsylvania, and you consent to the exclusive jurisdiction of those courts.

13. Changes to These Terms

We may update these Terms from time to time. The "Last Updated" date at the top of this document reflects the most recent version. We will provide notice of material changes via email or by posting a notice on our website. Your continued use of our Services after any changes constitutes your acceptance of the updated Terms. If you do not agree to the changes, you must stop using our Services.

14. Termination

Shoot Indoors reserves the right to refuse service to anyone and to terminate access to our Services at any time, with or without cause, at our sole discretion. Grounds for termination include but are not limited to: violation of these Terms, engagement in unsafe conduct, threats or harassment of staff or other users, illegal activity, or any conduct we determine to be harmful to facility operations or safety. Upon termination, all membership benefits cease immediately, and no refunds will be issued.

15. Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severable from the remainder of these Terms and shall not affect the validity or enforceability of the remaining provisions.

16. Entire Agreement

These Terms, together with our Privacy Policy and any posted Range Rules, constitute the entire agreement between you and Shoot Indoors regarding your use of our Services and supersede all prior negotiations, agreements, and understandings. Any additional terms proposed by you are hereby objected to and shall be void.
